VOLUNTEER WORK AND HOT SPRINGS LIABILITY WAIVER
1. PROPERTY & ACTIVITY RISK ACKNOWLEDGMENT I understand that visiting, volunteering at, and soaking at the property located at 50522 Hills Creek Rd, Oakridge, OR 97463 (hereafter referred to as "the Property"), owned and operated by Hot Spring Steward (hereafter referred to as "the Owner"), involves inherent risks. These risks include, but are not limited to:
Volunteer Work Risks: Use of hand tools, power tools, or maintenance equipment; lifting, carrying, and manual labor; slipping or falling on steep, wet, rocky, or uneven outdoor terrain; exposure to unpredictable Pacific Northwest weather, wildlife, insects, or irritating plants (such as poison oak).
Thermal Risks: Extreme natural water temperatures, hyperthermia (overheating), heat exhaustion, heat stroke, skin burns, and sudden blood pressure changes.
Physical & Health Risks: Slippery decks, historic structures, paths, or natural rocks; drowning; exposure to naturally occurring minerals, gases, or pathogens; dehydration; and interactions with pre-existing medical conditions.
2. ASSUMPTION OF RISK I explicitly and voluntarily assume all risks associated with my participation as a volunteer and guest, whether known or unknown, including any risks that may arise from the negligence of the releasees or the physical condition of the Property. I certify that I am physically fit, sufficiently trained, and have no medical condition that would prevent my safe participation in both the volunteer work and soaking activities.
3. RELEASE AND WAIVER OF LIABILITY In consideration of being permitted to volunteer, enter the Property, and use the hot springs facilities, I hereby take action for myself, my executors, administrators, heirs, next of kin, and successors as follows:
A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me, Hot Spring Steward, as well as any associated directors, managers, officers, employees, volunteers, and agents.
B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the individual(s) and entities mentioned in this paragraph from any and all liabilities or claims made as a result of participation in these volunteer or recreational activities, whether caused by the negligence of release or otherwise.
4. NO EMPLOYMENT RELATIONSHIP I understand and agree that my services are provided strictly on a voluntary basis without expectation of compensation, wages, health insurance, or worker's compensation benefits of any kind. I acknowledge that I am not an employee of Hot Spring Steward or the Property.
5. MEDICAL TREATMENT CONSENT I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during these activities. I understand that I am solely responsible for any costs related to emergency medical treatment, first aid, or transport.
6. RULES, SAFETY, AND ALCOHOL I agree to abide by all rules, safety protocols, and instructions given by Hot Spring Steward or designated project leaders, including wearing appropriate personal protective equipment (PPE) when working. I understand that the consumption of alcohol or drugs is strictly prohibited at any time on the property and drastically increases safety and drowning risks in the hot springs.
ACKNOWLEDGMENT OF UNDERSTANDING
BY SIGNING BELOW, I CERTIFY THAT I HAVE READ THIS DOCUMENT, FULLY UNDERSTAND ITS CONTENT, AND AGREE TO ALL OF ITS TERMS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
